Negotiations

Negotiations

Negotiation (noun): Negotiation is the process by which parties in conflict adjust their positions, by trading issues of lesser importance in exchange for issues of greater importance, because the agreement must be implemented by all parties.

The dictionary defines “Negotiation” as the “mutual discussion and arrangement of the terms of a transaction or agreement”.  However, “Agreement” can range in meaning from mutual understanding to binding obligation.

Negotiation itself is not just the element of facilitating an outcome for the interest of the client but ensuring the clients’ future interests are also addressed.  At Brisbane Dispute Resolution we analyse the big picture for your business and future negotiations and what will bring the most effective long term goals.  Brisbane Dispute Resolution have demonstrated that by exploring the options to expand the pie before employing a distributive approach will greatly increase the substance of what is to be negotiated at the table.  Mnookin said “through negotiation they may be able to capitalise on their different interests, resources and capabilities and discover agreements that expand the pie”.

Brisbane Dispute Resolution philosophy to negotiating outcomes for their clients is “the party with the backup plans and/or alternatives can control the direction of the discussion.  Brisbane Dispute Resolution has an approach that promotes listening and disclosure in a collaborative way which uncovers options that parties have not thought of to that point.  Brisbane Dispute Resolution employs a range of strategies that are tailored to each client’s situation and desired outcomes.  What we can say about our strategies is that more than one strategy can be used through the course of the negotiation by skilfully moving from one strategy to another depending on what is being discussed.
