Mediation

Mediation is a structured negotiation process in which an independent person, known as a mediator, assists the parties to identify and assess options, and negotiate an agreement to resolve their dispute. Mediation offers an alternative to legal procedings and/or a judge imposing a decision on the parties.

 

Mediation can save time, legal costs and  court costs.

There are some factors about your dispute which may indicate it is particularly suited to mediation, such as:

  • A willingness to participate in mediation;
  • The possibility that a judge’s decision will not end the dispute;
  • The need for parties to find a way to preserve their relationship;
  • The existence of non-monetary factors; and
  • The potential for a negotiated outcome that better suits the needs and interests of the parties than a judge’s decision.

Andrew Spropoulos, Principal Mediation Practitioner, has both nationally accredited and Post Graduate Dispute Resolution qualifications. Andrew is passionate about the dispute resolution field and commits significant time to the training and development of his peers. He does this by sharing his knowledge and expience by delivering professional development training and coaching to others interested in Mediation. He regularly faciliates training and assessing for Mediator National Accreditation with the Dispute Resolution Branch, Department of Justice & Attorney-General’s Department of Queensland in Brisbane and is a sessional staff member with Faculty of Law, Griffith University where he tutors and coaches 4th and 5th year law students undertaking the Post Graduate in Dispute Resolution course. As the principle mediation practition for Coast to Country Consulting Andrew draws on his vast experience (over 23 years) and long history  as a mediator and facilitating across many industries.

Our mediators do not give advice or pass judgment.  Mediators don’t have to be experts in law, as they don’t represent one side or the other, as solicitors do, or judge how the dispute should be resolved. They will assist disputing parties by helping them identify options with the aim of negotiating an outcome acceptable to each party.
